Please read the following terms and conditions carefully as use of and/or buying from the www.mrmuck.co.uk website means that you will be bound by them.

Waiver

Every effort has, is and will be taken to ensure that the information contained in this site is correct and up to date. The information may, however, become incomplete, inaccurate or out of date. To the full extent permitted by law, but subject to the terms and conditions of sale referred to below, we disclaim all warranties and representations (whether implied or expressed) as to the accuracy of any information contained on this website.

Definitions

For the purposes of these Terms and Conditions, the following definitions apply.

Contract. The contract for sale by us and purchase of Goods by you.

Goods. The range of garden products which are available for purchase from this site in accordance with the terms.

Website. Our world wide web address www.mrmuck.co.uk.

Use of this website

The content of this website is owned by or licensed to Mr Muck’s Garden Supplies Ltd. You may not copy, reproduce, modify, distribute, republish, re-sell, display, post or transmit any part of this website without the permission of Mr Muck’s Garden Supplies Ltd. You may view or print individual pages only for your own personal use.

Limitation of liability

This website should only be used for information purposes. Mr Muck’s Garden Supplies Ltd shall not be liable for any damage or loss that may occur in the use of any of the information contained or advice given in this site except as stated in the terms and conditions of sale (where applicable)and to the extent that such liability cannot be excluded by law.  Mr Muck’s Garden Supplies Ltd is not responsible for the website’s accuracy or its fitness for a particular purpose or the reliability of the access to this website.

Mr Muck’s Garden Supplies Ltd is not liable for any damages or losses resulting from your use of or inability to use this website. Mr Muck’s Garden Supplies Ltd does not guarantee that this website will operate free of error or that it is free from computer viruses or any other contaminating computer program.

We will not be liable to you or in breach of the Contract for delay or failure to perform due to any causes beyond the reasonable control of Mr Muck’s Garden Supplies Ltd or its suppliers, including, but not limited to, acts of God, civil commotion, industrial dispute, riots, flood, and legislation.

Data protection and privacy

Any details which you provide to us from which we can identify you are held and processed in accordance with our Privacy Policy.

Main characteristics of goods

Every item on mrmuck.co.uk will be accompanied with an appropriate description and by a representative image.

In some cases, the product may vary from the image displayed where the manufacturer has updated the packaging or improved the look of the product without informing us. Also note that colours can vary due to conditions at the time photography, possible natural variations in colour and also the setup and model of your computer monitor.

Pricing

All prices quoted are in British pounds (£) and include Value Added Tax (VAT). If the price goes up or down in between you placing and receiving your order, we will honour the original price.

Ordering and stock availability

Mr Muck’s Garden Supplies Ltd is an online business, our office and depots are not open to public access.

We aim to display only items that are in stock and which can be dispatched to you quickly. From time to time we may sell out of some lines, in which case we will aim to advise you within the 10-14 day delivery period. If this does occur, you will be given the opportunity to order an alternative or receive a full refund for the full price you paid.

Mr Muck’s Garden Supplies Ltd makes no representation as to the goods, items, products or services referred to in, or sold from, this website as being available or suitable for use.

Delivery

Mr Muck’s Garden Supplies Ltd where possible use our own vehicles and drivers for delivery. We may also use national pallet carriers and 3rd party couriers to deliver our products.

When delivered using our own vehicles, our drivers will off-load our products onto your property, garden, driveway or allotment by hand and leave in the most appropriate, safe place.

Delivery will aim to be between 9 am and 7 pm on the selected date. If you have any queries or alternative delivery requirements such as a next day service or timed deliveries, please contact us on 01302 725544. Surcharges may apply.

Pallet & courier deliveries

When we use national pallet carriers and 3rd party couriers to deliver our products, the drivers aim to contact you an hour before delivery to inform you of their arrival, a telephone number is required.

Drivers are instructed to deliver as close to the property as access allows, but only curbside delivery can be guaranteed. It is not possible to move pallets over loose surfaces such as gravel or grass. We are not able to move our products up inclines, along paths or to rear gardens. Access to sites must be using public highway over which a vehicle can pass without sustaining or causing damage of any kind.

All pallet deliveries are made using an 18 tonne HGV with tail-lift. In certain areas, we can request a smaller 7.5 tonne vehicle. All goods are delivered on a wooden pallet which is non-returnable.

You must give at least 24 hours notice if you need to reschedule your delivery. Unplanned re-deliveries are charged at £30 +VAT per pallet.

Orders returned to our depots once the products are in transit will be refunded minus the cost of transport at approx. £30+VAT per pallet each way to English destinations (additional charges may apply to Scotland & Wales). Goods must be returned in the state that they were received, shrink wrapped and accessible by a pallet pump truck and vehicle.

Mr Muck’s Garden Supplies Ltd cannot be held liable for costs incurred due to delayed deliveries which are out of our control such as acts of God, accident and traffic delays.

Shipping methods

We ship to UK locations using the following services:

  • 3rd party couriers
  • Our own vehicles

We select the most appropriate service based on weight, size and value. If you have special delivery requirements please get in touch.

Damages & shortages

It is rare for items to get damaged in transit but accidents can happen and occasionally there may be a packing error resulting in a shortage.

It is vital that all orders are checked on delivery and we are notified of any damages or shortages within 48 hours. In these cases it is best to call us to lets us know, but if you do email then ensure that we have acknowledged the email before the time elapses as we cannot take responsibility for non-delivery of an email.

If it is not possible to check the item at the time of delivery for any reason then please let us know so that we can discuss the risks involved in the item is not being checked. Unfortunately once the 48 hours have elapsed the couriers’ insurance lapses and claims cannot be made. This is why it is safer to always check items on the day of delivery even if the outer packaging appears to be intact. To speed the process up we may on occasion ask for images of the damage.

Cancellation

Orders can be canceled by emailing sales@mrmuck.co.uk stating the order reference. Credit / Debit cards will be refunded within 5 working days. If an order has been dispatched and the cancellation is due to the item no longer being required then it will be your responsibility to return the item or to cover the cost of the courier returning the item to us.

In the instance of a faulty product, we will arrange to exchange the item for a replacement of the same product. We may, however, need to determine the cause of the fault and the exchange would depend on the nature of the item / fault and the conditions of the manufacturers’ warranty. To speed the process up we may on occasion ask for images of the fault if it is a visible problem.

Please note that if one or more items are returned for a refund and the remaining items on the order would have incurred a delivery charge then this charge will need to be deducted from the refund value.

Returns Policy

If you are not satisfied with any purchase from Mr Muck’s Garden Supplies Ltd, you may return any products back to us, at your cost,  providing that the product is in a resellable condition, this means that the product is not damaged, has not been used in any way and that the product is complete with the original pristine condition packing. These Terms and Conditions do not affect your statutory rights as a customer.

Guarantee

This guarantee excludes damage resulting from accident, alteration, misuse, abuse or normal weathering.

Changes to the terms

Mr Muck’s Garden Supplies Ltd reserves the right to remove, modify or change, without notice, any information on this website from time to time. Mr Muck’s Garden Supplies Ltd may change these terms at any time by posting notice of the changes on the website. If you use the website after Mr Muck’s Garden Supplies Ltd has posted the changes you will be bound by the new terms. You should therefore ensure that you read the terms each time you use the website.

General

E-mails to you will be sent to the address you specify to us. You must only provide us with a valid e-mail address and it is your responsibility to inform us of any changes to that address.

To the extent that any provision of these terms is found by any court or authority to be invalid, unlawful or unenforceable, that provision will be deemed not to be a part of these terms and will not affect the enforceability of the remainder of these terms, nor will it affect the validity, lawfulness or enforceability of that provision in any other jurisdiction.

The headings in these terms are for convenience only and do not affect their interpretation.

These terms supercede any representation made by us or any of our employees or agents.

Statutory rights

The consumer’s contract with Mr Muck’s Garden Supplies Ltd does not affect the consumer’s statutory rights.

Governing law and jurisdiction

These terms and your use of this website are governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the Courts of England and Wales.
